Gina is actively engaged in a wide spectrum of civil and commercial litigation, arbitration and advisory work. She counts multinational and local corporations, both listed and private, among her clients, and has worked on a diverse range of matters including but not limited to commercial disputes, negligence and nuisance, insurance coverage and defence work, banking disputes, shareholders’ disputes, employment law, winding up and judicial management, and regulatory offences.
Pursuant to the Specialist Accreditation Scheme which was introduced in Singapore in 2017 and offered to building and construction lawyers in a pilot, she became the first batch of 24 lawyers to gain accreditation as a Specialist in Building and Construction Law. She acts in numerous construction matters for owners, employers, main contractors and subcontractors involving public and private projects, whether by way of arbitration, litigation, or adjudication, or by way of general advisory work such as preparation of contracts, payment claims or payment responses, and calling of performance bonds.
Outside of work, Gina was a tutor with the Singapore Institute of Legal Education (Bar Admissions and Examinations) for civil procedure, and volunteered at legal clinics set up by The Law Society of Singapore. She also gives seminars to clients on construction law and civil procedural rules.
WORK HIGHLIGHTS, representing:
- A listed developer in relation to alleged defects / sinking driveway of an industrial building. The case involved novel issues on the duty of care of a developer and what the normal industry practice is vis-à-vis developments built on marine clay.
- A listed Malaysian company in relation to a fraud perpetrated by its former directors and employees in excess of RM44 million.
- A main contractor in relation to the setting aside of an adjudication determination under the SOP Act before the Court of Appeal. The case was one of the earliest cases dealing with the SOP Act and addressed novel issues at the time regarding the consequences of the failure to submit a payment response and the duty of an adjudicator in determining an adjudication application despite the absence of a payment response.
- An international insurance company against an insured who originally claimed about S$21 million of benefits under various policies for alleged injuries and sicknesses suffered. Succeeded at the start of proceedings to reduce the maximum amount of benefits claimable to just more than $1 million based on the construction of the policies alone.
- An airtug operator of a local airline who caused damage to Changi Airport, which resulted in a closure order that led to business interruption losses to tenants, among others. The case involved novel issues of the principles that apply for duty of care in relation to economic losses.
- A majority shareholder of a listed company in a dispute with the white knight of the listed company, leading to applications and cross-applications arising from various contracts such as a sale of an intellectual property agreement and an implementation agreement.
- An individual who faced charges under the Securities and Futures Act for alleged market manipulation.
- A listed developer against a main contractor in relation to the collapse of walls of an industrial building, many years after the completion of the industrial building.
- An insurer of a CAR policy against an insured arising from damage caused by the insured during its works in a land reclamation project. The insured commenced action against the insurer for cover under the CAR policy, which the insurer denied under the marine liability exclusion clause. Other issues included whether the insured should claim under the CAR policy or the P&I policy, whether subrogation is allowed upon the P&I insurer paying out under the P&I policy, and whether double insurance applies in this case.
